Problems With A Permanent Pass For P&I Surveyors

obtaining a permanent pass for P&I surveyors. Administration of
Ukrainian private terminals introduced own pass and security regime
and have additional pass requirements at the terminal territory and
sometimes serious obstacles for P&I surveyors attendance on the
vessels berthed for cargo operations at terminal’s area occur.

Steel cargo – Problems

steel-plants to the ports by railway using open platforms or open
wagons and stored at open area in the port open storage sites
unprotected from elements, oil and grease from port equipment stains

Disputes With Custom Authorities
Under the Ukrainian Customs Regulations, the local customs
authorities require to complete a customs declaration for inward
clearance prior to arrival at the port. The customs declaration shall
contain all items on board, including goods, materials, spare parts,
bunker quantity, paints, medications, etc. The list of mandatory items
to be declared is not clear enough and this results in significant
problems with Customs Authorities when some items are not
declared properly.

Disputes With Immigration Authorities

In Ukraine, administrative cases are subject to several laws: the Code
of Administrative Transgressions, the Customs Code, and the
Immigration Regulations, to name a few. Under the Law,
administrative matters should be finally settled by a local court. A
Master can represent Shipowners in the court together with a local
lawyer for administrative cases. He is also entitled to authorize a local
lawyer to represent Shipowners with a special power of attorney.
